En virtud de lo anterior, se deja constancia que con el mismo acto de acceder y usar nuestra tienda on-line, el usuario reconoce que es totalmente responsable de las consecuencias asociadas al uso del producto adquirido en nuestra tienda on-line, ya sea este uso ejercido por él mismo o por cualquier otra persona que tenga acceso al producto.

En los casos en los que la normatividad y ley del Perú no permita la exclusión o limitación de responsabilidad por daños indirectos o incidentales, nuestra responsabilidad deberá limitarse, expresamente, a lo mínimo exigido por la ley.

SECCIÓN 14: SEPARABILIDAD

De llegar a determinarse que cualquier disposición de estos términos de servicio es ilegal, nula, no aplicable o inejecutable, dicha disposición, sin embargo, será ejecutable en la medida máxima permitida por la legislación peruana, y la parte no exigible se considerará separada de estos términos de servicio. Determinación que no afectará la validez y exigibilidad de cualquier otra disposición restante.

SECCIÓN 15: TERMINACIÓN

Las obligaciones y responsabilidades de las partes incurridas antes de la fecha de terminación se mantendrán tras la terminación de este acuerdo, para todos los propósitos.

Estos términos de servicio son efectivos a menos y hasta que sean terminados por el usuario o por nosotros. El usuario puede terminar estos términos de servicio, en cualquier momento, notificándonos que ya no desea utilizar nuestra tienda on-line.

Si, a nuestro exclusivo criterio, un usuario no cumple, o sospechamos que no cumplió con algún término o disposición de estos términos de servicio, podremos rescindir este acuerdo en cualquier momento, sin previo aviso.

SECCIÓN 16: ACUERDO COMPLETO

El hecho de que no hayamos ejercido o hecho cumplir cualquier derecho o disposición de estos términos de servicio no constituirá una renuncia a dicho derecho o disposición.

Estos términos de servicio y todas las políticas o reglas de operación publicadas por nosotros en nuestra tienda on-line, constituyen el acuerdo completo entre el usuario y nosotros, y rigen el uso de nuestra tienda on-line, sustituyendo cualquier acuerdo o comunicación anterior o actual.

Cualquier ambigüedad en la interpretación de estos términos de servicio no se interpretará en contra de topishopp.
